Buyer might not be able to get finance....

Heard from buyer today seeking another 2 weeks extension... I'm taking it as kind of good news....? If he couldn't get finance all together, he would have just asked to end the contract I'm assuming. If he's asked for an extension, I guess there is still hope and he still wants to buy the...

Buyer might not be able to get finance....

Thanks for all your comments. I did read that any defaults stay on your credit report for 5 or 7 years I think it was... and even if you have paid or rectified it, it will not say that on your credit report. *sigh Regards, rupert11

Buyer might not be able to get finance....

Hi all, In the midst of selling a property.... After being happy with the B&P, Buyer's finance was actually due yesterday (21 days from contract date) but his conveyancer called mine on Friday asking for a 4 day extension...we granted it seeing no problem. Agent has emailed me today...

    Withdrawal of Caveat?

I hadn't looked at the orders for a while, it just says: Brother's half share from the proceeds to be divided xx% to the ex-wife and xx% to the brother. I recall my solicitor saying something like that, that his half would be placed in a trust account for them to deal with but I guess it's...

    Withdrawal of Caveat?

My brother's half share will be made out to the ex-wife's solicitor's trust fund as per court order. I did talk to her, only to ask her to contact her solicitor to contact my solicitor and then to contact my brother's solicitor. Who said Family Law issues were complicated? The real doozy is...

    Withdrawal of Caveat?

Hi cu@thetop, My brother and I have 50/50 interest in the property and his half share will be put into (her solicitor's) trust account to divide accordingly as per their agreement. It shouldn't effect my half. The whole "just to notify her" thing was something her solicitor fed her. I...

    Withdrawal of Caveat?

Hi Kristine, I see. I always had good intentions but now I can see how it may not look that way. I never thought about it like that. So I'll stay out of it. I'll let her know that she'll have to let her solicitor handle it and I'll just have to trust that will be done at settlement...

    Withdrawal of Caveat?

Thanks all for your input. We certainly want to make sure there is a clear title for the buyer at the time of settlement in order for the sale to follow through. I just needed clarification on what form/fees needed to be lodged and by whom in order to get it properly lifted. And yes, I admit...

    Withdrawal of Caveat?

Hi Aaron_C, Thanks for your response and advice. I'll advise her to go ahead and lodge the withdrawal form privately so we can all have piece of mind at settlement. I never trusted what her solicitor told us, so I'm glad I've got some reassurance now. Cheers, rupert11

    Withdrawal of Caveat?

Hi all, First time poster, long time reader. Looking for some advice regarding withdrawal of a caveat. I own an IP in QLD with my brother. My brother has since split with his wife, resulting in said ex-wife lodging a caveat over our QLD IP by advice of her solicitor. (In her solicitor's...
