    Scammed into signing over house

Wouldn't the better question be who witnessed her signature on the Transfer?

    Issue with Solicitor

What was the purchase price of the property? I know the Queensland LTO has a sliding scale on their registration fees. Your summary of the statement didn't include LTO fees. Could they be the difference?

Deceased Estate has not gone to probate 7 years after the death.

A Power of Attorney means squat once the principal dies. The only people who can control the estate are the executor (by the sounds of things, the mother). As Terry says, if she is unable or unwilling, then the court can appoint someone else.

    technology vs washing machine

I had a pair of earphones that went through the wash, and then the dryer. They still work now, and that was about 5 years ago.

Vehicle in son's name - how risky is this?

Tell him he has until date X before you report the car as stolen or take it to the wrecker.

Buying in QLD, father signs on behalf of my corp trustee.

I'm guessing this was disallowed because from what you describe, the Mother was signing on behalf of the son. If the company (by it's Sole Director) appointed the Mother as an attorney, then would that not be different? Why not have your company appoint your father as it's attorney? The PoA...

    Settlement on Monday...but...

In an ideal world, vendor calls bank: Vendor: Hi.. remember that Mortgage I paid off years ago? Bank: Yes.. you paid it off.. we gave you a discharge form. Vendor: Yeah, I lost it.. can I have a new one? Bank: Sure.. ok.. you don't owe us any money anymore, it's kinda silly for us to have...

Still on title as owner - 6 months after settlement

I dare say this would be illegal. While he may still be on title, he's passed on ownership, etc to the purchaser by way of the transfer paperwork and the contract for sale. There's probably not much you can do.. I wonder what the purchaser's bank would do if they defaulted. I'm sure...

    Caveat on properties

Perhaps the OP has signed loan agreement, etc.. but has been unable to register their Mortgage? (unsigned or problem with Mortgage paperwork.. ?) Wouldn't this entitle the CBA to an equitable interest as mortgagee?

Public Trustee as tenant in common

Hi Mop, what is the background here? Who owned the property before the Public Trustee came along? From what you have said, I would assume it was yourself with a 61% share, and someone else..? You need to remember that the Public Trustee aren't an owner here.. the are a personal representative...

Aussie investor with a U.S partner

Welcome to the forums. A quick google search brought me this result. It is just a response from answers.com, and I'd assume each State would have different requirements with regards to paperwork, etc but I'd say it's a yes. We let foreigners own property here, after all.

Title Holder passes away before Settlement. How to negotiate a licence to occupy?

Correct.. it will all come down to what is said in the Will. You might be lucky, and the deceased may have left their share to the other Tenant in Common.. but go easy on them. They have just lost a loved one.

    Caveats lapsing after 3 months???

The legislation in each state/territory will vary, but I can tell you that in Queensland, Caveats are valid for 3 months, and will lapse, unless the provisions of s126(1) of the Land Title Act 1994 are met. What you'll need to do is check the relevant legislation for the state/territory in...

Buying at Receivers Auction with multiple mortgages and caveats

A lot of this comes down to priority. If the first mortgagee is the one exercising power of sale, then they won't need to provide releases.. nor will they need to remove the caveat (assuming the caveat was lodged after the first mortgage). Section 79, of the Land Title Act 1994 (QLD) states you...

Dilemma: Buy property now from parent or wait for will?

Err, don't wills normally discuss what happens if a beneficiary pre-deceases the testator?

Dilemma: Buy property now from parent or wait for will?

If you went with the Joint Tenants option, It'd get messy if your mother died before your grandmother. You'd be back at square one. The grandmother would re-acquire the whole of the property.. so when she eventually dies, (assuming there is no change to her will) this would be split between...

    Under Contract (urgent)

Interesting idea. I'm not sure how the other states work, but in QLD, I'm sure the Registered Owner would be able to lodge a caveat seeking to prevent the action by the Mortgagee, if they provide evidence that the correct procedures have not been followed by the Mortgagee. I agree with Lofty...
