    Searches for off-the-plan apartment unit

Searches can't be started on an OTP until registration is achieved in any case. The searches referred to above would be what we would recommend, but if it were me personally, I wouldn't do TMR or contaminated land, however its not a massive saving when you are spending thousands. I would...

Losing faith/trust in lawyers (selling property)

I am amazed that your lawyer has initialled an amendment to a contract settlement date! I am a conveyancer working for a lawyer, and this would never be done in our office in a million years! Transfer documents have to be signed and returned to the seller's solicitors - this is standard...

Joint owner with mum need legal advice please asap!

If you hold as joint tenants, you could sever the tenancy so it is converted to tenants in common - each party still owns half each, but in the event of either owner passing away, the will of the deceased dictate who gets the half share owned by the deceased. That way, you could leave your...

Anyone heard of Managed Property? Brisbane based Property Managers

I've heard of them on the sales side, but not property management.

    Property Managers-Morayfield/Caboolture

I have one IP in Caboolture South (small 3 bedroom) in quite a good area and its been consistently rented for the 5 years I've had it. I may actually end up living there (not the IP) at some point. I wouldn't buy where I wouldn't live myself.

Rates adjustment on a subdivided property?

Yes that's correct. As registration was only recent, rates were on the block as a whole. DNRM will need a new valuation on both blocks and rates will then issue on each separate lot, backdated I believe to the date of registration. Hope that makes sense.

building and pest report came back

Your solicitor is not a pest/building person - you should be telling them what you want, not them telling you.

Who will you leave it all to?

To my children as my husband passed 6 months ago. If they die without children, it goes half to my siblings, half to my husband's siblings.

Swimming Pool Safety Cert? Buyer or Seller's responsibility?

I am pretty sure you can't legally rent the property out unless a pool safety certificate is in existence in any case.

    Help! Transfer duty concession OSR

My understanding is that the tenant must be an existing tenant and that they can only stay for a maximum period of six months after settlement. It is all set out in the Form 2.1.

    Paying a deposit

We see lots of contracts with only $500 to $1000 deposit, not 5% at all. Some of them will have a small payment up front with a larger deposit when it goes unconditional. As long as the contract is subject to finance and/or pest and building, you should get the whole deposit back if your...

    The order of proceedings

Solicitors do searches, but not the survey - usually the buyer would organise this direct with the surveyor to my knowledge

Agent refusing to tell us body corporate rates

In Qld, it is up to the Seller to provide this, so the agent is talking out of his **** in my opinion.

How hard is it to get into a Private School if you're not baptised?

We go to church every week and had no problems at all in getting our oldest into private high school (not catholic) for next year. The kids aren't baptised either, as we don't believe in that until the child decides for himself/herself when they are ready.

What paper work do you get once your property purchase has settled ?

All we received was the letter from the Solicitors (which I did myself as I work there lol) and the letters from RAMS who financed us.

    Settlement figures

You as the seller are liable for the registration fee on your the Release of Mortgage and your bank's costs for attending settlement. Why should the buyer have to wear that? The release registration fee usually gets deducted from your settlement amount at settlement and the banks generally add...
