Depends on the size of the builder. If they're small, run. Even if you increase the cost of your job, it wouldn't be enough to keep them afloat to stop them going bust. That is of course assuming they're telling the truth, it seems suicidal for a construction company to be lying about going...

Just go for vacant possession. You're well within your rights to do so, and you'll save yourself any potential headaches in the future. Just do some research as to whether $400 is the current market value, don't just take the agent at his word.
