Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

I have not really wanted to look on here - just kept working and battling on to get this finalised.... To all those who helped me out with advice THANKYOU and .... Finally!! It settled last week. For the price I was willing to pay him before he got his lawyer involved - also under the top...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Thankyou Wylie for all that above - including the red comments which I couldn't quote - all extremely helpful. I've just finished a letter to his lawyer in response to the one I got today again threatening Supreme Court action. I've enclosed my valuation this time - the one I already had when I...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

The general suggestion is great though on further thought - if it comes to that, then it may help him to be more realistic! Thankyou Perp.

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Because his valuation is so completely inaccurate that I am not taking it into account in any negotiation.

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Wylie if you re-read the posts you would see that I wish to buy his share out. The original question was because he got a dodgy valuation as he wants a far higher price than it is worth and I was querying what I could do about the valuation. It's so misrepresentative I thought it was probably...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

To answer the last three - yes - best if you read back to get the whole situation before commenting! But briefly - I own 50%, I want to do the work and I want to keep it (ie buy his half from him). He has an inflated idea of the value. (Read back because that was what the original post was about).

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Sorry to bump this again by answering the posts but I'm so appreciative of everyone who has taken the time to respond and wanted to answer all. I've been working lots so it's taken me a while to get back to the comments. Thanks again, I think I've got most of the info I was after, sort of...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

I would politely suggest that I do understand what they have tried to do. Sorry I cannot post the whole document and then you would also. I have tried to explain it and the quote probably just confused the issue. Yes they have done the workings and deducted 'all associated costs' - not...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Thanks Terry - Well, I suppose it then depends on how soon both of us want this ended. If he goes the supreme court route I'll definitely be seeking advice on buying the share I already have offered in writing at market value to buy. I want this over, but have paid my share of the rates for...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

I haven't changed my mind. He can either send to auction (which would fetch around the price I've offered at a high cost as per the info received on here - thankyou!). Or he can try to bully me in other ways. Unfortunately for him, I think the lawyer letter threatening supreme court action might...

Definitely not. Nothing at all. I would have mentioned that.

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

I don't want to auction it. There would be costs of the auctioneer and supreme court action etc. I think he may be ridiculous enough to . The only positive thing about auction is that he will have to admit market value is much less than the valuation he has engineered. Not simple unfortunately.

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Well, in my letter to his lawyer I said the bank's offer to loan me money has a use-by date. I also said I've been offered another job which if I take it, will mean another at least 3 months before I can get another loan approved (the one I have is currently unconditionally approved). As...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Hi Keith - *** again the auction suggestion - my question about auctioning it is above, hope you can weigh in on that. **** End result he wants? - well I've stated all this before but there are a lot of previous posts to scroll through. At first I wanted him and I to develop it together. That...

Can anyone answer that for me? Cheers

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Thanks for your 2c, but I think what is missing is how he gets to the point of auctioning it. Most of the posts on here that talk about auction assume he will just OK the auction process. The only way I can see that he will auction it is if he takes it to the Supreme Court (as he has threatened)...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

I doubt he'd agree to an auction unless forced by the courts. He seems to be contradicting himself because he's threatened the Supreme Court (which I understand would probably end in a decree to auction via trustees) but he doesn't want the price he'd get at auction! And I'm not the one...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

Yes it's definitely not as good a deal as the valuer thinks. I really want to do it here because I already own 50%. He wanted to sell out, I wanted to buy. What could go wrong :( If I have to defend myself in the Supreme Court would I actually have to 'lawyer up' ? (again loving that term...

Valuation: 'as is' Market Value vs Projected Future value after development. Dispute

If we put it on the market tomorrow what is it likely to realise? 1. The value 'as is' ? or 2. the value it would be worth if it was already subdivided and the existing house completely cleaned up, fixed up??
