CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

Hi Dualitii, It depends what it's approved as an whether it was built under the old City Plan 2000 or the new City Plan 2014. I've seen a multitude of different approvals for properties like you describe. For example:- House with secondary dwelling Rooming Accommodation Dual Occupancy...

CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

Multiple leases on a property in Brisbane City Council are not unlawful. I took BCC in the P&E Court late last year on this matter and won. The BCC rates department have a rating category for it (multi residential) and I have a report from the author of City Plan 2000 stating that multiple...

BCC have confirmed that "common provision for food" means a kitchen, and is not about eating arrangements.

Standby people. Brisbane City Council are about to try and convince a court that granny is unlawful in a granny flat :) Can't wait to see how this one unfolds.

Thanks. Found the court documents now. Just looks like 2 very lengthy affidavits. Is there something that outlines what BCC are asking of the court?

CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

You probably have similar stuff, but I have a legal document from Brisbane City Council where they have stated that a house and granny flat, rented separately, is not a multi unit dwelling. If you're hitting the courts again on this issue then let me know if it's of any interest to you. When...

When did they lodge this? I can't find it online on the eCourts site so it must be pretty recent. I'm very interested to see what they are asking to be clarified and why they would go to all the expense of the P & E Court Originating Application for a plan that has now been superseded.

Oh, also confirmed.... Rooming Accommodation can be done in a House and is self assessable if you meet the Acceptable Solutions in the Rooming Accommodation Code (which includes 5 or less people and meeting the fire safety requirements). There is no requirement for them to be students The...

CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

I have received some initial clarification from BCC regarding their new City Plan, and it's uncovered a massive conflict. "Household" definition "Common Provision for food" means a kitchen "Other essentials for living" means other self contained facilities (eg. bathroom, laundry etc.)...

CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

Yes, you could do it before so long as there were no more than 5 people and it fell under the House Code. The difference now is that they've split it into the Rooming Accommodation Code. Very significant. The new household definition requires all occupants to have a "common provision for...

CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

Disregard the fact sheets, they are not the statutory document and are often misleading. If you check out the Dwelling House fact sheet there is a section dedicated to granny flats which contradicts the code. In subsequent communication I've had with BCC they have debunked some of the so...

CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

In plain English... The new code allows for 5 individuals on separate leases/rooming accommodation agreements in a normal house (so long as fire requirements are met) in low density residential zoning. There is no requirement for them to be students. This is no mistake. It allows BCC to...

The fire safety requirements are pretty straight forward ; nothing to complex or costly there.

CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

Yeah, you might not have picked it up because the Rooming Accommodation Code was not included in the Draft Plan that went out for public consultation. So essentially, the public doesn't know about it and has not had the opportunity to have their say on it. When it was initially included it...

CAUTION Dual Living/ Duplex / Granny Flat Brisbane City Council Action Against Owners

Looks like BCC have changed the rules again and the new plan will help. It has a new Rooming Accommodation Code which allows 5 households in low density residential zoning. The Household definition has also been modified to remove the Rooming Accommodation exclusion.
