    Fine

That would be nice... But if you have a read of the Road Safety Act 1986 (Vic) in section 77 (2) The following people may prosecute for any offence under this Act or the regulations...(b) a municipal council Then in section 87 (1) If a person who is referred to in section 77(2)...has reason...

Getting out of Body Corporate ...

You would have to get a new title drawn up and surveyed for your property, as well as you neighbours' strata title (which would now have only 2 units). You'd have to fund the legal costs for both titles. This is a significant expense - you should look at whether its worth it or not. Of course...

Title deeds, where do the old ones go?

For Torrens Title properties (99.9%), the title is not a physical certificate any more; it is just a record in the Titles Office register. The certificate you got is just an official notification of the information the Titles Office holds about the property. As long as your name is there, you...

    Are you average?

It's a bit misleading to compare yourself to this "average". Most people's wealth is negative initially due to education costs, then increases throughout their life as they build assets, then finally decreases as they draw down their assets during retirement. An overall "average" of $665,000...

    Kids & Stairs

I think you cannot refuse to let the house to them just because they have children anyway. For any reason, safety or otherwise. As long as the stairs are built to a normal level of safety (i.e. building code), I can't see how you would be found negligent.

    Am I being excessive?

The tenants may threaten to leave, but if you are charging below market rent, where will they go to? All the other similar places will be more expensive anyway. Your tenants don't sound dumb, they will see this and accept the increase I think.

Whose responsibility to clean exterior structural windows in apartments?

In my apartment, the owners corp maintains the exterior of the building, including cleaning, painting, etc. A guy in a cherry picker comes every 6 months to clean all the windows. All the owners split the cost. The external faces of the building are Owner Corp property - not individual...

Should Owners Corp be paying this?

Depends on the plan of subdivision. If the roof is part of the common property, then owners corp pays. If the roof is part of your individual lot, then you have to pay (perhaps under insurance if due to storm damage). Perhaps the plan of subdivision has an elevation diagram which would...

    Service Central

Have used Service Central and the guy was great. He mentioned several times if I could put feedback, so they are clearly motivated by the feedback system to do a good job. Seems like it's similar to eBay - one bad feedback turns off a lot of potential customers.

    body corporate war heats up

A large part of the body corp fees is usually insurance. The penthouse holders own a much larger proportion of the building. If the building burned down and the insurance paid out, they would get a larger payout. They should pay a bigger share of the insurance premium if they are getting a...

    A horror share story

The "shares" are actually just units in a trust, associated with holding companies and a management company (run by Mac Bank). Even if you got more than 50% of the units, I think you can only change the trustee - you would have limited control over the holding companies themselves (which are...

    Nintendo Game&Watch (1980's)

These game & watches are actually going up in value - as they get older and more and more of them break (manufactured in 1984, they are now 22 years old), there are less on the market. For Donkey Kong 2, a couple of years ago a working version in fair condition was around $50. Now closer to...

can Banks just call in a loan?

The legal avenues are there for the banks to call in a loan if they doubt your ability to repay - even if you are not in arrears. But the reality is the bank would be desperate to do this... The negative press and political difficulties would be overwhelming. There would be a real risk of...

    Dissolving a body corporate

If the units are all on separate titles, you can't dissolve the body corporate. The body corporate is established with the strata plan and continues as long as the strata plan exists. As the sole member, you would still need to ensure the body corporate does all the required things, such as...

    Noise Cancelling Head Phones

I have a pair of Sony ones - MDR-NC6 - which work pretty well. You can turn off the cancelling in a quiet environment if you want. It's not that they completely cancel all noise - they just remove the low frequency sound (like aeroplane engines) so you can listen to movies or music with the...

Buying a House with No Mortgage

Oynas, if workers aren't sucking up to pay their mortgages, they're sucking up to pay their rent. When you sign a 12 month lease, that really a bigger commitment than paying a mortgage on a house you can sell anytime. Of course, you live at home, so you don't have to pay rent or a mortgage...

    Smokers?

I think many people give up smoking when they have kids - explains why lots of younger people at work smoke out the front, but not so many older ones. Everyone knows the health problems from smoking... But when people are addicted, rationality goes out the window...

    A horror share story

I would recommend getting some legal advice before embarking on anything like this... I've attached the corporate structure from the PDS, as you can see it's very complex, and unclear what rights you might get from owning a majority of the trust units. Just a word of warning :(
