Negotiating a rental - tips? - renters perspective

Really surprised by some of the responses on this thread. I've negotiated price or other conditions on several places I've rented. It IS a free market and that means buyers (renters) and sellers (landlords) have to agree on a price. Why should only one side get to choose the price. If I were...

    Where are the renters?

If demand/supply ratio rises but capacity to pay doesn't there's only one other outlet. People will simply not rent. They will begin consolidating the population into the existing housing base, more people per property. Or become homeless. Whether prices will fall to meet acceptable...

    Problem with Agent and Tenant

Are you suggesting you could walk into a court and wave a contract signed by person A, tell the magistrate that person A told you they were signing for person B and that they told you person B agreed, that if person B claimed to know nothing about it and denied agreeing that you would have a...

    Where are the renters?

An interesting take on the housing 'shortage' http://www.crikey.com.au/2010/10/12/housing-shortage-dont-dwell-on-it-there-isnt-one/ I think the argument is reasonable one. The rental market is the only part of our property market that isn't distorted by varying credit conditions. You can't...

Problems with tenant transfering from Fixed Lease to Periodic?

It's two months regardless of if you in a fixed term or periodical. If you're in month 5 of a 6 month lease they can stay until month 7.

Is a rental application approval binding on landlord in Qld?

Hi JigglyPuff, The sales agent has let slip that that buyer wants to occupy so definitely not an opportunity to simple lease from new owner. I tried that option first because I though it would be the easiest for all concerned.

Is a rental application approval binding on landlord in Qld?

good thinking on their part... I might lodge a caveat just to be sure. I think most solicitors do all the searches in the last couple of weeks before settlement so if I get it lodged tomorrow the buyers might see it and contact me to find out what the story is....

Is a rental application approval binding on landlord in Qld?

actually I was speaking to my current agent about the situation today when she came to do an inspection (she's a very cool agent). She pointed out that that if a property is put on the market within the 1st two months of lease the tenants have the option to break lease at anytime while it's on...

Is a rental application approval binding on landlord in Qld?

I've spoken to two different people at the RTA and explained the story in excruciating detail. Both indicated they thought there was definately a binding agreement in place.... But interestingly both muttered quite a lot about verbal and implied contracts. One mentioned that verbal was...

Is a rental application approval binding on landlord in Qld?

I would think so to. That of course depends on whether they plan to tell the buyer though. They may just be trying to hold out until it's settled. Though I'd think that's pretty dumb if it is their plan. I can't think of any way I could find out who the buyer is short of lodging a caveat...

Is a rental application approval binding on landlord in Qld?

Well the plot thickens with this one. I've made several attempts to resolve this quietly. But I'm not getting anywhere. The property went under contract a couple of days after it was listed. I called up the selling agent to see if the buyer was interested in renting it out. They told me...

Is a rental application approval binding on landlord in Qld?

Hi Rolf, long time no speak... It was Whiteside... Dead centre between Petrie and Dayboro exchange and very marginal for ADSL. I'm a web developer and therefore ADSL is mandatory so had to ensure it was available. I told the agent straight up that if I'd signed a lease without checking and...

Is a rental application approval binding on landlord in Qld?

*facepalm* why didn't I think of that? I just spoke to them and they had the opinion that it was definitely a binding agreement. They weren't sure if I had recourse through the tribunal or small claims court but I'll follow that up a bit further.

Is a rental application approval binding on landlord in Qld?

I had a rental application approved for a property I wish to rent. Now it's a long story but basically between the approval and the signing of the lease there was about a 2 week period during which I had to connect phone/adsl/electricity. This was done with full knowledge and agreement of the...

    Whoops - no building permit!

Went to visit a mate yesterday who I haven't seen for a few months. Turns out in the meantime he's built an entire granny flat which he wanted to show off to me. It's all very nicely done and after the usual investor talk about value adding etc I was naturally interested in the permitting...

Tenant wanting a landlord's opinion please

"may not" is an explicit prohibition. When have you ever heard someone say "you may not do such and such" meaning that you probably shouldn't but it's ok if you do anyway?

    Renew Lease - 3 or 6 months

and if they've ever had any experiece trying to rent a property at that time of year they'll know it's the worst time for them to be looking for a new one. If I were told that I'd be outa there quicksmart...

Agent trying to poach my listing

Thanks for all your suggestions. I told agent B I wasn't prepared to risk losing my 77k buyer so he could only have an exclusive listing if it excluded that buyer from the listing agreement. He came back and said do an open listing and would just have to get me a better offer before my 77k...

Agent trying to poach my listing

Yes I guess I am looking for some perspective though. I am thinking I have listed it too low. I made the decision after getting some very bad financial news and at the time thought I would have to do a fire sale so I priced the block very competitively. I have been genuinely surprised at the...
