Property damage - tenant pays or Insurance claim?

Fair enough, although not sure how you could enforce tenants have liability insurance. Would you request a copy of their receipt every year that they pay it and issue notice to vacate if they don't have it? That sounds like it'd be tough to do and with costs of re-letting and potential...

Property damage - tenant pays or Insurance claim?

Thanks Perp, once again a very informative post. What I don't understand is, how would the liability component of tenant insurance, if the tenant had it, help the landlord in the opening post? Wouldn't the landlord still either have to make a claim on their building insurance, and the...

Property damage - tenant pays or Insurance claim?

This is where the differing opinions are. You are saying a tenant can insure the building, whereas others here in Australia are saying that you can't, only the owner can. Either way, I don't care, it's not an issue I have to deal with so I'm not going to investigate the definitive answer.

Property damage - tenant pays or Insurance claim?

That's what I thought! I think people quoting Canadian law on an Australian property forum is very misleading and pointless.

Property damage - tenant pays or Insurance claim?

Property damage - tenant pays or Insurance claim?

I'm not talking about contents or public liability though. I'm talking about the actual building, which the landlord owns. How does a tenant insure something they don't own? So if the house burns down, how are they covered except to rely on the landlords building insurance?

Property damage - tenant pays or Insurance claim?

That's a scary story for a tenant! I thought tenant insurance in Australia only covered their contents, not the building, so what option does a tenant have here to cover themselves other than to use the landlord's insurance if the building was damaged/destroyed?

Property damage - tenant pays or Insurance claim?

Fair enough too. Imagine if as a tenant if you were responsible for all building damage that you caused accidentally. You are unable to take out building insurance because you do not own the building, so imagine if you took this problem to the extreme, and let's say the whole house burnt down...
