Also. The we would appeal and go for 3 but might take 2 in mediation if that was the only thing to get you across the line.

We need to move now. mediation is part of the appeal process. the beauty with P&E is that we can treat each as a stage. Yes if we went all the way to 3 day hearing you will be up for $50k. They may roll at notice of appeal with a precdent and it could be <$5k, mediation could be <$10k if...

That can be used as precedent in appeal if the same flood levels apply (or even if they are close).

The BCC subdivision guidelines don't contemplate this and that is the issue. If the lots were already subdivided then you can build your house on stilts. To subdivide blocks you need to meet flood immunity for a specific area (think it is 300m2 of each lot or 60-70% from memory)

Fair point about cost. BCC are extremely picky about anything to do with flood since 2011, chatting to engineers about possible solution shouldn't cost much though.

I think the engineer didn't try and offer a solution to the issues more than anything. Engineering report that offers a solution would resolve and you would be up for another set of app fees but still cheapest way out.

Have spoken to various parties. No way to save now. Engineering advice from the report provided highlighted adverse impacts without offering a solution to fix. Too late to resolve now. Overall a very frustrating, annoying and expensive process. Commercially in a situation like this it is...

Apologies for not getting through to me, not sure why as I have staff at both businesses to answer the phone, although I don't work in the planning practice day to day. Phone call to the law firm will be get me or at least get a call back within 24 hours if I am tied up. DA may be able to be...
