This depends... It is usually negotiated by the parties beforehand. Sometimes the landlord owns the fit out as it may have been provided as an incentive. Whoever owns it it should be well documented in the lease and/or other agreement. Best to put a personal property security act charge too as...

It won't hurt to list it and see how it goes. If it sells for near then amount then it would be time to get out I think.

Sounds like you need a new solicitor. He won't be entering into any leases so won't be signing anything. It will be the lessor and the lessee entering into a contract - whether lease or borrowing. You should get legal advice about the the non-conforming issues and about the SIS act in...

Accountants can't give legal advice so can only advise on limited aspects of SMSFs - tax. Who is 'he'? Why do you think it is a proforma document? What about associated legal advice? Why should a patient pay a doctor a high fee for 'proforma' advice? You have already made some major...

Oh dear, no lease, no loan agreement. Better speak to your lawyer tomorrow. Who owns the fittings?

And when you do sort it out why not have an IO loan with the ability to pay extra if the trustee decides?

    Opinions on my situation

Surely the terms of your loan to your SMSF would already be in writing? Hasn't it settled already? could this transfer be counted as a contribution instead of a loan? What are the tax consequences? Would it be a commercial arrangement to lend a third party money without a written loan agreement...

Someone knowledgable in privacy issues perhaps. No, not everyone, or probably hardly anyone would seek legal advice. Its up to you whether you do or not. Is a shop a public area?

Surely you are not going to rely on an internet article about this? It would be like a doctor taking diet advice from womans weekly??

Man, what sort of operation are you running! Must be a big operation? I use TPG for home and have never had a problem. I signed up with them for my office gave all my details and they said there were not enough slots open in the exchange and they asked me to call back in 3 days. I did this...

China, just make sure the right person is paying the right bills - you as tenant or the SMSF. If you are paying SMSF bills instead of the SMSF this could be counted as a contribution.

Big costs for the conveyancer and SMSF set up and they didn't even provide proper advice from what you have said earlier!

Of course there is! Leaving tax aside for the moment, there are contractual risks for one. Employer disputes with staff, contractors, suppliers etc.

I've said it before and will say it again... China, you are crazy - using an accountant who is not giving good advice, using a conveyancer for a complex commercial (are they even allowed to do commercial properties?) and SMSF transaction - watch out for double duty issues. Your business is...
