    Even if she does produce it now, it wasn't produced before she moved out. If your losses are more than the bond, that may make a difference, if it goes to Tribunal. Either way, she is out.

    Wylie, We have a lot of tenants moving out one day, and new ones moving in..and for the most part, it works out fine. On occassion we offer to accommodate new tenants too. You won't get any flack from me.

    Careful Wylie...you are starting to sound like me :D We're lucky..anything we do ourselves (cleaning/repairs etc), we are are compensated at the Tribunal. After keys are handed back..they are deemed to have given up possession.

    Until the LL has been given/ shown a copy of the AVO, it does not exist ! Treat these people as any other tenants. When they get into rental arrears, lodge the proper paperwork. Unless they have given you written notice they are moving, in the proper form, They have not given notice...

    Agreed. Chances are, they have done this, or similar , before. We have a lot of singles, recently separated, who put a bond down on one of our rental properties. Before they move in, they 'kiss and make up" with their partner...then think they should get their bond back. Sorry...go away.

    If it was me, I'd start issuing the proper notices if they don't pay their rent. Until you have proof of an AVO, it doesn't exist.

    Dreamgirl, Have you seen proof of an AVO? As Skater said, I wouldn't release any bond to them either, until a new tenant is found. From the looks of it, you may be up for rekeying the property, if all keys aren't returned. I would hope all landlords use secured keys? ..or at least...

    Does it also state that any lease can be broken when agreed to by both parties? That is why I said get them to sign it over.

    Get them to sign the bond over to you as compensation to breaking the lease. Tenants lie. They will tell you any story, to get out of a lease.

    We run into this situation often. We tell them we will not remove the other from the lease. We also inform them, if the partner calls and asks us to open the door for them, we are required to...unless they have a restraining order to show us. It is of no benefit to us to remove anyone...
