Lease Break – 6 months into 12 mnth lease. Landlord cops 50%

I am familiar with and have landlords insurance. I was thrown by the term renters insurance. Probably having Canadians trawling an Australian website can lead to a difference in terminology and confusion.

The PM I use is a very well regarded agency in the area with a large network in Bayside Melbourne. I am very comfortable with their actions. Though I may not necessarily agree with their interpretation, they know VCAT better than I do. In the 13 yrs they have managed this property, because of...

Email Reply from PM This is the email reply from my PM...... Your letting fee as per your agreement with us is for one weeks rental letting fee. The clause that indicates ''up to 1.5 weeks"' will depend on the authority with a client. Your authority is that we only charge you one weeks rent...

Nothing. I have reviewed and questioned them as I work with the PM's. Agreed. We all have vested interests. Once you understand what motivates people (and its ususally their source of income) you can see where there may be issues and clouded actions.

What help - showing me a copy of the Canadian Tenancy Act and then banging on about tenant insurance which is a foreign concept here in Australia which only causes more confusion. Dazz has also deleted his messages. So there was not much help there was there?

I have similar wording in my lease too under special conditions - ...a re-letting fee of no more than 1.5 weeks rent and reasonable advertising costs. Have a guess who i am going to call tomorrow? It aint going to be Dazz and Almost Bob and the others who suggested I am ........ for...

Now that the legislation is very general (no-one can point me to the specific section) and thanks to Chasethesun and others I will have a detailed look at the lease now and see how specific it is.

Thnks for adding no value whatsoever. What is Dazz's point? - go read the legislation or dont trust your Property manager? If i trusted my PM I would not have asked this question of fellow property investors.

Lease Break – 6 months into 12 mnth lease. Landlord cops 50%

This is my reading of the Act. It looks like its very broad. There is no reference to whether the re- letting fee should be split or paid in full by the Tenant. At the end of the day its all about determine(ing) the compensation (if any) to be paid by the applicant for the order to the other...

I believe i have a handle on things. I have an accounting background and started life as a auditor so I always have a healthy dose of scepticism and conservatism. Now i ply my trade in the IT side of things now. The intial portion of the letting fee at my expense did not fit well with me...

Thanks for that. So i read on a previous post your tax accountant claimed $100k as a repair instead of as a Capital item. Maybe you should have spent more time reading the Income Tax Assessment Act instead of the Residential Tenancy Act. Can you scan the Income Tax Assessement Act for me too...

Well I certainly have conflicting opinions now. I emailed another agent I use in Victoria who also reckons they pro rata. So now I have two property managers I have alot of respect for, now saying they pro rata. But i am not so sure. Maybe i need to take Dazz's advice and do some...

Good to see Dazz has a fan. You must be really home sick living in Canada and surfing an aussie web site. So is the policy on this forum to bag people who ask a question that can be found in reading a tonne of legislation. I would have thought it would have been a reasonably easy answer...
