Check your insurance. Some (most?) policies insist on having a lease in place with a fixed date (ie. not a month to month lease). Issue breach notice and get the eviction process started. They will either catch up or not. If they catch up you can decide how to move forward.

I would suggest you allow them to stay the few weeks over Christmas ONLY if they pay rent in advance. Make sure they have been given due notice of a final date so they cannot play games.
