In the first instance it was the small disputes division, pre trial conference, so no solicitor involved or allowed to represent us, however, much time invested/wasted.
I gained a lot from this experience though and as I head towards the next pretrial conference I’m feeling quite confident & much stronger than I did the first time.
All learning experiences I suppose, but one’s I’d much rather do without.
The Department of Housing & Works is the office that deals with dividing fence issues here in WA. Their purpose is to assist with queries and concerns that relate to dividing fences, they have a booklet called Dividing Fences Rights & Responsibilities; it covers most matters concerning fences.
I have spoken to them & my local council and am sure that this matter will be dismissed; however, unfortunately I still have to go through the motions.
Thanks for the P.P.S. I have someone to help, thought these issues where too petty to pay the fee, I like the idea of full indemnity costs, not sure if it applies in my case though, but I will get advice this time around.
