When you ring the Department of Fair Trading you MUST INSIST on having =the agency investigated!!!

Unscrupulos (can't remember how to spell!) Real Estate Agents freak when =they have spot audits and know they're being investigated.

YOU MUST INSIST. And the Dept Fair Trading is like a dog with a bone!!

Well I have good news!!!! They paid up! Well I have a cheque which I deposited ASAP to make sure it don't bounce...

I basically rang them on Friday and said "I am coming down to the office at lunch time and the agency manager better be there if they do not want me to take legal proceedings against them". I went down there and thought I should be calm and collected to start with and if that didn't work I would say that I would be starting legal proceedings against them and badmouthing them to everyone I know (they don't know I already have!!).

Anyway they rang their bank while I was there and still no progress - they wanted me to get a letter from my bank stating how to get there money back and saying that they agree to pay the money back to Elders when they get it - I said that it was impossible for me to do so as from what ANZ was telling me I was a third party and had no interest in the money.

After a protracted convo in which they insisted it was not there fault and that they had received legal advice telling them not to pay me and that they were under no obligation to do so...I said that I was speaking to the small claims tribunal etc and that I would find it necessary to be very annoying to them until such time as I received the money - and she agreed to give me a cheque if I wrote a letter saying that if the bank paid me the money I would pay it back.

Anyway I won!!! But - found out (after the fact - I was in such a hurry to run out with that bloody cheque) they had overcharged me for fees - luckily I owe them $100 for some gardening that was done and I will take it out of that.

Hmmm - it does worry me that their lawyers told them they had no obligatioon to me...any legal eagles around??

Great news!! Rachel 1 REA 0!! I'm glad you got it sorted out so quickly, especially before Christmas...! Now, I'm not a legal eagle, but it seems to me it may have just been a smokescreen, because if they had received legal advice that they had no obligation to pay you, why did they? Somehow I can't see some agents (especially the ones in your case!) handing it over out of the good of their heart just because they can, especially if they have been advised otherwise... anyway, all's well that ends well!
