Broken water drainage pipes

Hi guys,

A friend has signed a contract for a property and settlement is a month away. It has come to their attention that there are some issues with the water drainage system at the back of the house. This issue has been going on for three years and the vendors have only fixed part of the problem.

Water from the pipes underground, from the back of the house, is not flowing through to the front of the house and the footpath. The pipe is damaged at some point/s, causing water to leak out in to the soil, damaging the neighbours property. The footpath is also damaged. The neighbour mentioned that the council can force the current home owner to repair the pipes, but this seems to not have occured.

The neighbour has paid their excess as they couldn't wait any longer for the matter to be resolved. The insurance company are yet to recover their cost.

What's the go from here? Does the vendor need to organise repairs before settlement? Will my friends be responsible for damage that was caused before they owned the property, eg pay the neighbours insurance company since their's won't cover them for an event that occurred before the policy was taken out?

They've asked the conveyancers and are yet to hear back. Thanks for reading. Hope someone can help in the mean time.

Maybe ring up the plumbing department and talk to someone in the council about the problem first,i don't know what's it's like in your area but in Brisbane Urban Utilities would not let this happen for three years, then ring up the insurance company,and it always pays to use a Solicitor...
