Maybe it is different in each state but as I am not a RE agent I don't know
for sure. What I have read in the news is that if you take on an agent and
sell privately he can sue for his commission (NSW) possibly for breach of
contract on your part. I have heard that if one agent is a listing agent and
another agent sells the property then they split the commission (VIC). If
you sign an agreement I would be very careful about selling privately as if
the money is big enough they will come after you. I think the NSW example I
read about the commission was in the vicinity of $20,000. You not only have
to think about the ethics of what you do but your legal position as well.
I too have agents tell me they are working for me (the buyer) and will get
the owner to drop their price. I have used agents to work on the seller by
making an offer and not moving, rather let them do the work to determine if
the seller is motivated enough. I too have been gazumped when dealing
through an agent and refused to enter a bidding war. I have read
"Confessions of a Real Estate Agent" and spent my time nodding my head over
most points Terry Ryder makes as those things happened to me.
One final point, if someone's ethics allows them to do things that are
bordering on the unethical would you be prepared to do business with them? I
applaud Kevin having a clear conscience and ask the others what kind of
person do you want to be and to be remembered as? How many of you are caught
up in the hype of making a dollar and screw the other party to do the deal?
