Certificate of Occupancy

Hello again

Our solicitor was in the process of gathering and reviewing all parts of the contract for sale before we signed. We found out that the unit block which the unit we were interested in has not been issued with a Certificate of Occupancy from the local council (Holroyd, NSW).

As it happened, later the same day we were informed we had been gazumped so it wouldn't matter anyway now since we are no longer in the running to buy the unit, but my question is:

Is it against the law to live in/rent out a property if the Certificate of Occupancy is non-existent?

Thanks
