Contract Condition - Council Application

Hi,

Just wondering what kind of clause (and is it possible?) would you need in a contract to be able to submit a DA or documentation for council approval for a demolition or building works. Would be great to get the approvals prior to settlement so that on settlement day would be ready to go. To be able to allow survey, design, etc. to be undertaken?

Swear I have read similar on the forums but have done a search and haven't been able to find anything.

You just need a simple clause saying that the vendor agrees to sign any DAs and associated paperwork to allow the purchasers to submit to Council, in the period after exchange and prior to settlement. A good solicitor would be able to draft the clause.
 
You need to get a solicitor involved. You may need an irrevocable power of attorney incorporated into the contract or via deed.
