Penthouse roof not common property

Can someone explain this:

THE management committee of an exclusive [Melbourne] CBD apartment block is at war with three residents over who should pay the $200,000 cost of reconstructing the building's two landmark copper domes.

Two months ago the elected committee of the building's owners' corporation dropped a bombshell on the owner-occupiers of the penthouses under the domes atop the Grand Hotel building in Spencer Street. It instructed them to each pay $100,000 for the works.

Mrs Watson and Anne and Bill have sought legal advice. Anne said the domes ''belong to the building''.

Following this logic, the owner of any top floor flat is responsible for the roof?

That is extremely unfair - if the body corporate is dictating what substance you have to use on an area that advantages all, then all should have to pay.

Otherwise a colorbond hip will do thanks - or leave the roof off and body corporate can pay for the mess next time it rains!
