RE agent commission

Hello all IP gurus:
I sold a CBD unit couple of months ago and
waiting for settlement (due to an outstanding
council notice). If the purchaser pulls out of the contract and I do not intend to pursuit, am I oblige to pay the agent commission (because the contract fell through)

If the purchaser pulls out and the sale does not go ahead, there is no commission to pay as there was no sale. Simple as that!
