Sharing fencing cost

Hi everyone,

I am thinking of removing some old asbestos fence around my newly built house and install some new fencing.

Reasons:
1) It will be safer
2) More aesthetically pleasing

However I would like to have my neighbours contribute to some of the cost.

Does anyone have a letter template they use to request contribution from neighbours especially one that includes the law? that states a shared fence cost should be shared between the neighbours?

Why not simply have a chat with them and see how they feel? A letter quoting legal issues may well get their backs up if that is your first approach.

And, as said, unless the fence is in poor repair your neighbour is under no legal obligation to contribute just because you want a different fence.

Yes I've have talked to the neighbours and mentioned that I'll be changing the fencing, just wanted to make it official in written form. Doesn't hurt to use the law to persuade :p
 
What is considered as an insufficient fence?

Some of the fence are in a bit of a bad condition with holds or breakage.

Page 2 of the booklet

A ?sufficient fence? is:
? a fence prescribed by a local government law; or
? a fence of any standard agreed upon by adjoining owners
provided that it does not fall below the standard prescribed
by the relevant local government law.
Where no local law or no agreement is made, a sufficient fence
is:
? a substantial fence that is ordinarily capable of resisting the
trespass of cattle and sheep; or
? a fence determined by a Magistrates Court to be a sufficient
fence.
