Will - Is set up correct??

Hi all

Here is the basic precedent that I use for this sort of a testamentary trust, it is will that establishes the trust and is designed for use with children who are still minors.

And there is a second included for children who are adults, although this one also creates a trust even if your spouse does not die at the same time as you, but givers her a life interest.

Did you do a will which starts the process to create a trust when you pass away or did you do an actual trust?

Hi BV,

The testamentary will trust is established upon our death. Thus the assets we have now (excluding our discretionary trust) will move into this trust.
