'Common ground' but exclusive use

Hi all,

Quick FYI update:

Went to VCAT & owner of this apartment was deemed liable for the (approx) $4K costs associated with the tree damage which they have since paid. The ruling was something along the lines of he who benefits most from the repairs is liable for the cost of said repairs.

Good result all round from my perspective :)

Next 'hurdle' will be working out what to do with the tree as it will require yearly maintenance of approx $1800 to make sure the roots don't damamge the apartment again...oh well, another owners corp meeting...can't wait *sigh*
