Getting document from the previous owner

I just bought my first home, and in the process of trying to settle.
I need a document from the previous owner which is just a statement to proof that it's a brand new house, never been sold, rented out before.

But the owner's conveyancer is not helping, been waiting more than a week from them now, and next monday was the scheduled settlement date, but we still haven't got the statement.

What do you guys think? Can I say it's not my fault that we can't settle next monday?
Is there another way to proof to SRO that it's a brand new house?

Would have thought that unless it is a condition of the sale that they provide this evidence before settlement then you are the one at fault for delaying the settlement. You have signed for the property, it's time to pay!
