I have a signed contract to buy a property in WA.
In the contract there is a subject to clause stating
"This offer is subject to the sellers agent providing the buyers agent with a full copy of the certificate of title and any encumberances within 24 hours of acceptance of this offer"
The purchase is for a place that has yet to be subdivided so it doesn't have a title is this technically a way out of the contract?
If the advice is to see a solicitor then anyone know a good one in Perth? They are hard to come by over here as most property related work is done through conveyancers.
