Just witness or do you need legal advice? A non lawyer could possibly witness.

Well that is completely different to your first post. Will not be just a signature but a lawyer going thru documents and explaining. Estimated Cost $300 to $500.and will take 1 to 2 hours.

Legal advice I believe
Certificate of independent financial advice
& clients certificate

I've had to do it when guaranteeing a loan. Cost me about $200 (but I might be wrong) and it took about 45mins as he went over the implications of guaranteeing a loan.

If you google independant advice you will find a few that specialise in it.

Have you thought about asking for an extension to the settlement date when the solicitors are back? Worse case is the vendor serves a rescission notice and you have a further 14 days to settle. This may reduce your stress during this part of the year when you should be enjoying a frothy :)

I paid over $500 about a year ago for this - was the most expensive 3 minute phone call of my life and totally unnecessary but what can you do?

It was (almost) literally "do you understand what you're signing?"
"Yes"
"Goodbye".
:)

It was a certificate of legal advice, not a sig witness.

That lawyer took a huge risk. How would he even know it was you he talked to. And a 3 min phone call would be evidence that he didn't explain much at all.

There is a case where a lawyer did one of these for a husband and wife. The lawyer had known the husband for years, but he never met the wife. One day they come in to get mortgage docs signed to get a LOC over their unencumbered property. It later turned out it was not the wife but the girlfriend - guess who was liable for the loan!

Terry beat me to it. How did the Solicitor verify it was you he was giving the advice to?
