Land tax when building PPOR

Hi all,

Just writing to ask for some advice regarding Land Tax (Victoria) on vacant land when building your PPOR.

Here is the scenario.

1) We bought land (settled in Oct 2009) and built our first home. Neither of us (husband/wife) have ever had a PPOR before or claimed a land tax exemption.

2) We put in a land tax exemption form as this house is our PPOR and we have been residing here since Feb 2011.

3) We just got a letter from The State Revenue Office claiming that we are being investigated and owe just over 2k in land tax.

4) The SRO state that as we moved in over 12 months from the settlement of the land, we are liable for land tax in that year. We moved in approx 15 mths after the settlement of the land.

5) With council planning/septic tank approvals/building hold-ups etc it was outside our control that the build would take that long.

I'm sure that many people would have had similar experiences when building a new home.

The SRO have said that we should pay the money and then apply to be reimbursed as this is our PPOR. They were very non-comittal on the reimbursement.

Seems unfair, do we have options to appeal/other avenues we can take. Not keen to pay up-front and hope for reimbursement. How long would reimbursement take anyway?
