Major defects - who pays?

UPDATE: Miscommunication. The agent clarified that she will send me the invoice as proof that the job was done, NOT that they would "invoice me" for the work.



The building and pest report came back with one major defect noted - the stairs leading up to the house (replaced recently when renovated) are the wrong specification - they are not the legal depth and need to be replaced immediately. We thought something didn't seem right at first as my foot didn't fit comfortably on the step as I was walking up - and I don't even have very big feet!

Anyway the agent said they will fix it and invoice me for it. Why am I paying for this? Is this cause to demand that either they pay for it or I pull out? Does this constitute B&P failure?
