non-strata units and driveways

Hi,

I just have a query as I have a dispute with neighbor parking in their driveway. Coming out of our driveway, we face a small lane road, on my right is a shrub which obstructs my view and, when the neighbor parks their wagon on my left, also obstructing my view. I put up with it for a few months until I almost got into an accident because of cars speeding along the lane which I did not see because of their wagon. I asked the neighbors nicely to park in the visitors instead (because their garage is full of their stuff) but the neighbor reasoned out that when they park at the visitors their car gets plenty of bird ****. Having said that, the driveway has no roof anyhow. :confused:

I have not tried the property manager as previous requests takes months to be actioned. The building is non-strata as there is only one owner. Is it the neighbors legal right to park along that driveway? I have attached a bird's eveview of the garage/lane area. I am just bothered as I think I have made a reasonable request and, feel that the neighbors are inconsiderate.

Maybe check the lease agreement.

I got a side by side duplex and it states the garage is for car parking, not to be used for storage space, etc.

Tenant still parks in front of garage in the driveway (i'm sure they are using it for storage or a porn set), but I don't mind, the driveway is wide enough and quite a deep setback from the street.
 
Thanks for the tip Ace, I will check the lease agreements tonight. The previous tenants had a small car, so I did not mind as much. But the new tenants have a wagon which is long. Our garage is the most difficult one to get in and out of, and, I always park reverse, as it is easier to get out. I would not have mentioned anything if I had not had a close call.

Unless its in the lease agreement or you can get agreement from the owner on the safety issue I don't like your chances - it's reasonable for a tenant to expect to be able to park in their own driveway leading up to their own garage.

Have you considered strapping a mirror to the shrub on your right? That would give you a reflected view of the oncoming vehicles on your left, and it would be easy to see as you come out front-first anyway.
 
Thanks for your input, Softmonkey. I think if I were to strap a mirror on the shrub, won't take too long till it gets stolen. We are near a train station, the garage has been broken into before.

Ace, not too sure what a "setback" means. But when they park the wagon, I think it just at the line of the pavement. Our garage is the bottommost near the shrub, the shrub is even covering it on the picture.
