Selling at Auction. Not 1 Bid. Would you pay advertising? (Vic)

If you were selling at auction. Not one bid. Would you pay the advertising?

Surely there is some expectation you get something for all the money supposedly expended.

Comments appreciated.

Of course you still have to pay for the advertising. The number of bids is completely irrelevant. If the ads weren't placed, that would be another thing, but of course when you agree to ads being placed on your behalf, you have to pay for them.

What would make you think otherwise?

Although looking at it from the other side of the fence - where does the buck stop?

The newspaper / realestate.com has charged the agent for the placement of the ad.

The people who took the photos, write the ad copy, maintain the website, put the newspaper together did work and expect payment. Is this not fair - afterall almost no one goes to work for nothing?

Whereas you the vendor want payment to be based on results rather than time expended. Again this appears fair - you expected a service and expect to pay only if satisfactorily performed.

The seller of any service will always want to extract a bit more money for a bit less work, while the purchaser wants a bit more product for a bit less payment. Ditto for other terms such as what triggers a payment.

As others have said the answer will be in the sale contract you signed, which is unlikely to be in your favour.

What if someone put in an insanely low bid (say $200k) on a $400k property? Their budget might be far lower than what you're willing to sell for. Would this have made you more favourably disposed towards paying, even though the result is likely to be the same - ie no sale near the price you want?

In Qld the auctioneer is entitled to "register" a bid without disclosure. In the only experience I've had that was the only bid on the night.
