Time stamped inspection photos admissible in court?

Hi Guys,

There are a few iphone apps out there that do a time and date stamp overlay on photos taken, i need to know if these would be acceptable in court over disputing damage.

Just unsure as something like this can be easily photoshopped from my view.

Cheers

Generally if you can give evidence under oath that you took the photos at a particular time it should be fine anyway.

Time stamps are a bonus.

You'll find most cameras and phones embed a shittonne of "metadata" in images including camera settings, exact time shot (down the the minute or second), GSP location in some cases etc.

You'd be marginally safer to rely on that as evidence (though on many cameras you can change the date setting which will throw this), assuming you'll be the one taking the photos or who took photos, and will have access to the original image files.

Depends...the other side of the story may have photos with same date but different condition of room, wall, window or whatever it is in conjecture.

Who does one believe then...?

It's very easy to manipulate photos today, including metadata.

better to have an independant witness along with the photos.

Photos with affidavit swearing to it will be sufficient for evidence....then it's up to the Court to decide who to believe.
