Damaged window - who pays to fix?

Hi All

With last nights 120km wind gusts in Melbourne, I had a call from tenants letting me know that the window will not close due the chain breaking off and the frame is now bent. See attachments. I?m assuming that they had the window open at the time it snapped.

The apartment is on the 25th floor and is self-managed. Building insurance is part of the body Corporate fees.

Will body corporate/Building insurance cover this cost?

Insurance may cover it, but you'd have to double check with body corporate as usually they only cover common property but as it's external you might be lucky.

Your tenants should be taking care during storms to ensure windows are closed, doors and in the case of houses gates etc. so I would try to make them pay the cost to fix/the excess.
 
Ok so I just found out that the window was closed when it poped out. The apartment is 3 years old. Body corp think its a builder warranty claim or insurance. Wait and see. Hope it doesnt fall out being 25 floors up. Hope it doesnt rain.

If it were me, I'd be getting some emergency fix so it doesnt fall on someone - perhaps removing the hanging glass and putting up a board.

That could kill someone if it fell.
 
I arranged a few emergency repairs over the wind & storms we had last week. Broken glass/windows = safety concern! I had a handyman attend and board it up and all insurance agencies I have dealt with this week have agreed that the handyman invoice for the 'make safe' visit can be included in the claim.

Hell, even if it isn't it's a small price to pay to make sure that doesn't drop out!!!
