ebay and gst - uh oh

Guys,
just got this message from ebay stating GST needs to be included in the price of items being sold there.

Does one need to include the gst and pay gst to the ATO if selling off some books or cds etc?

This is an important clarification to our announcement regarding changes to eBay's GST Policy. Please read carefully.

On May 23rd eBay announced a change to its GST Policy, under which sellers must include GST in their item prices and not add GST on top of the final price of an item.

Our announcement incorrectly stated that the policy change would become effective 24 May 2005. The date that the policy change actually comes into effect is Monday, 13 June 2005. We sincerely apologise for any inconvenience.

Below is a copy of the corrected announcement.

Since 1 July 2000 eBay has strongly recommended that all members include GST in listings, where applicable. As of 13 June 2005 all items listed must include the GST component in the price of the item from the time it is listed, where GST is applicable.

eBay has taken this position to require that all items be GST inclusive after receiving feedback from members who felt confused or disappointed if a seller later charged an additional amount in respect of GST. This policy has also been implemented after liaising with the ACCC and reinforces our marketplace as being an open and transparent one.


Sellers
If you are a seller who is required to be registered for and pay GST, you must ensure that the GST component is included in the price of the item from the time the item is listed. You must not add GST on top of the final bidding price or Buy It Now price once your item has been won or bought. Sales to overseas buyers are considered GST free.

This means sellers who are listing using the auction format and that are required to charge GST will need to set aside 10% of the final value for GST purposes. The 10% must not be added afterwards by the seller.

Buyers
The change of policy means that all listings on eBay are considered to be GST inclusive, where GST is applicable to the transaction.

That message is aimed at people or entities who are required to be registered for GST.. Rest easy you will not be required to add 10% and send it to the ATO. Your price is still deemed to be "GST inclusive" but there's no GST component in it.
 
This is simply to stop people from listing items, then later adding 10% onto the price after the item is sold as a GST component (which is not the correct way to invoice).

The requirements to be registered for GST have not changed - that is to be carrying on an enterprise and to have an annual turnover of over $50,000. Taxi and car service drivers are still the only industry who are required to be registered for GST even if their annual turnover is only $1, so no need to worry if you are a casual ebay seller.
