Fence on boundary with Coucil reserve

Hi,

Our new PPOR has a boundary fence along a council reserve.

What do you reckon our chance are of getting the council to pay half the replacement costs :rolleyes:

Zippo! The legislation specifically excludes Councils from this obligation - sorry! (I'm in the same situation.)
 
Yes agree with Perp - she's right (as usual).
Councils of all persuasions specifically write themselves out of fence cost sharing with their neighbours.
The good news is that you don't have to discuss fencing type or colour choice with them :)
 
Hi Guys

Seems to be a bit different in Melbourne, councils don`t share costs on fences abutting
streets but do contribute to the cost of fences abutting reserves.

Spoke to another owner late last year who had jumped up and down about this and council did a boundary check and found that the owners property had encroached onto council land by 1 meter. Actually it was the previous owners that did it (conveyancing searches - don't get me started) Anyway Council asked for $30,000 or removal of the double garage. Dearest fence he ever replaced.
