flooded

I recently bought a unit and 2 days after i moved in the person renting in the unit above me left a tap running in the sink (with the plug in) for hours. This flooded my unit below, I need new carpets and floorboards were soaked (hopefully they wont warp/rot). Should I have to pay for the damage or should the owner of the unit upstairs cover this with there insurance? I am getting told different things by everyone. Any advice would be much appreciated.

Call your insurer.

They will be very quick in passing the problem to the neighbours insurer if they can do so.

Should have a fast answer there.

your insurance should cover water damage/bursting/leaking etc.
is a standard peril.

your insurer would then subrogate/take action against the at fault party and their insurer. they will do this without your involvement - you should simply advise names/who's at fault/how happened etc (all when you lodge your claim).
