Forced to build a road?

Hi All,

I was looking at land that has no 'proper' road to it. It is not gazetted by council. I was talking to someone that mentioned that DA may stipulate that I would have to build a road as a condition of DA approval.

There are other houses on the existing 'road', but they were built 20+ years ago.

The current 'road' is pot holed quite a lot (first gear only in my 4x4)

Any thoughts on if it is likely, and if it is, can you get around it?

Ive seen it hidden in the contract of sale before on one block and also as a requirement for approval for any subdivision on another.

If your just purchasing an existing property and it already has a house you are probably pretty safe but best to check.
 
It does not have a house, just land.

It does not have the road in the land purchase contract, but I expect the issue would come after the purchase when a DA is put in.
