and dont forget, if the buyer doesnt settle on time in QLD, even by one day, they can lose their entire deposit, unlike other states where you have penalty interest etc. etc.!!

I couldnt believe it when I found this out the first time !

yes the court system is a joke, avoid it at all costs. one judgement took 18 months to deliver... it really wasn't that difficult

to be completely fair it was only 7 years, 2 additional years was the OTP part of the contract, the rest was arguing the bleeding obvious

I looked at a house once back in '99.

The agent said: The clothes line is going (it was concreted into ground)
The motors from the Ducted air conditioning are going.
The TV aerial (just a standard aerial) is going.

This is the same house which had a picture of the Husband and wife on bedroom wall with a smashed frame and Porno magazines half hanging out from under the bed.
Was quite a nice house as well except interior was terrible.

I would think they have no way to get out of the sale. You need to get onto your solicitor immediately. If you don't have a solicitor, (ie. if you were planning on using a conveyancer), get one immediately.

Does the 5 day cooling off period in Queensland apply to sellers as well as buyers? Or just buyers?
