Building with tenants?

I currently own a property in which I wish to build on the back of however the property situated at the front of the land is currently tenanted am I able to build a second dwelling at the back whilst they are still living there?

Unless they agree then nope. They maybe open to the idea or may want compensation for it. Put it in the new lease if its up for.renewal soon. It will take you a while to get plans and finance approved etc so take all that into consideration.

Can you begin to plan the building while they are in the house, such as send planners to the property ect?
 
Your tenants are legally entitled to " quiet enjoyment" of their rented property which would preclude building activity.

You will have to wait till their lease ends.

No, otherwise they will call the Rental Police on you. They will confiscate your rent for 6 months.

Seriously, it's paperwork with the odd visit from a surveyor and architect.

For The first few months all you will need is a surveyor to visit the property, from this you can get plans drawn up, council approval, build prices and contracts and finance started.

Give tenants the required notice to have someone visit the premisis.

Then maybe a valuer down the track if finance is needed then will be the equipment to clear the block.

Hopefully by this time you have a new contract with the tenant or new tenants.

HD_ACE is right. You can get your property manager to arrange the access for your surveyor, builder etc. Generally, the tenants won't be too much worried. You need to be concerned and compensate only when you do actual built. At that phase, make sure the development is included in new lease and accepted by the tenant. Give plenty of time for the tenant to make a choice to stay or move. Also make sure all you development time frame and builder is finalised by the time you write the new lease.
