Our property is adjacent to a laneway that his owned by our neighbour (who is a religious order). We currently dont have have right of way access but I belive before the flats at the rear were built were built their was a gate at the rear of our property (the remains are still in out garden) giving the previous owner car access. there are a number of other propeies that use the lane, most have highway access, but two flats are land locked and require the lane to access their property.
We would like to build a gate in the fence against the lane so we can park our car in the back yard. What do we need to do?
Do we need a formal agreement with the lane owner or just council approval with no objection from the lane owner.
