looking for an introductory book on common law

I know nothing about (Australian) common law and am interested in reading an introductory book.

Can you recommend a book to me? Thanks

Do you want the Aus legal system in general or the cases that developed a certain area or of common law. Give me some more detail and will see If I can help.

Hi,

I don't know specifically. It is a new subject to me.

I know it only by name, "common law". And I am wanting the information to be correct for Australia.

OK?

Just go to a university 2nd hand book shop and pick up a copy of 'laying down the law' - new editions are produced so often you can get the old ones for free usually.

Laying down the law's first author is cook. 7th ed will be heading for $200. You could always try google or google scholar and see what articles you can come up with.

Here is some light reading

Cross discusses obiter rictum v ratio decidendi ie things a judge discusses during a trial v the rational of the decision.

the next 2 are some classic common law cases. I will attach a few more in the next post. They are early contrac, negligence, duty of care fidicuary duty cases. thousands of cases have applied and built on these decisions.

And finally a modern classic. Defamation on the internet. Proper court for hearing defamation, where it is uploaded or where it is downloaded?

Followed by a word doc that has some q&a regarding common law and precedent

and finally an article on the history of australian contract law.

all of these docs would be copywright but as only small section produced would be allowable under fair dealing.

edit: unfortunately the gooley is uploading as a jpg when it should be a pdf.

Pete

I rang up the free legal advise phone number last year- number in phone book under court houses.

Anyway they read the information out of a handbook. I am reasonably sure you could purchase one of these handbook but I can't remember the exact name.

Regards
Sheryn
