No, I wasn't able to get anything back, as my PM took things in cash, with no paper trail. He would actually drive to their homes to collect it, so even the staff in the office had no idea anything was amiss. It was his word against the tenant(s), as to how much was paid. Plus, things like no bonds lodged were only found out after tenants vacated.

Even if the rent was collected in cash, it is the responsibility of the agency to deposit the collected rent into the trust account and to then pay it to the landlord.
If the correct process isn't followed, the agency is responsible and their license can be withdrawn.
If its in NSW you'll need to apply with the office of fair trading for compensation.
They need a copy of the rent ledger and a copy of your bank statements to show that the money wasn't deposited into your account.

JameZ - thanks for your kind words. we're making some progress at the moment, but all goes very slow. fingers crossed we'd get possession of the place in the next few days...can't wait really to sever the last tie with the incompetent agent.

If I ran my law business like that I would be struck off. I would liked to have heard the other side of the story (if there is one) but I expect thst we won't be- at least on this forum.

The company is unfortunately still playing games at this stage. They asked local PM that I wrote to them to formally inform of management change. But when I did this, I got an email back saying that they would only act to DFT instruction and asked me to put through this request via DFT! :roll eyes: I'm just speechless....

DaveM, yes I'm not sure what's going on in that shop. It has potential, but something seriously wrong is going on there.
Yes, I know that we don't need to involve DFT in management move. We only need their help (and NCAT) now in getting documents required for insurance claim.
