I do think it's still worth including, if nothing else to send a signal regarding expectations. I'd also back it up with lots of dated photos that you print out and get the tenant to sign acknowledging that it's a fair reflection of the condition of the garden at the beginning of the tenancy.

Would they help you at Tribunal? Probably not. But it sends a signal regarding your expectations, and the tenants' reaction to being asked to sign is informative as to what kind of tenant you're getting. Many tenants probably think it has some standing and will take good care of the garden as a result: win!

So just because it's not enforceable doesn't necessarily mean it's a waste of time, I agree.
