Urgent advice needed

My sister in law has purchased a house and land package with McDonald jones in Oran park. They have waited 8months to get the land registered and everything finalised and now they are saying they can't have a decent backyard because the house won't work.

The package was sold to them with a 10mtr backyard and now they are saying they f-ed up and they will only have a 2.5mtr backyard because the house has to be pushed further back.

The lady at McDonald jones even said in her own words we f-ed up, not professional at all saying that to a client.

Needless to say my sister In law is really upset and doesn't know what to do. Can she get compensation for the big stuff up.

Can anyone recommend someone for her to speak to. Etc property lawyer or solicitor.

Have Mcdonald Jones offered any solutions to them? Perhaps a different design which would allow a bigger back garden at no extra cost etc etc
 
No they haven't offered anything. To get a bigger back yard they would need a smaller house which they can't do. They suggested a double storey but they don't want that and they don't even know if they can build a double on their land.
 
What's changed since they signed the contract? Have the block dimensions been reduced? Someone couldn't read? Subdivision is dramatically different from what was purchased?
 
They purchased their land in Oran park I think around 8 months ago, they have recently just had the land registered, plans drawn up by their builder McDonald jones for the house they want built. McDonald jones have said yes all good to fit their house on their land and they will still have a 10m backyard. The plans were drawn up, approved by council, gone to land titles and now they have come back saying in the lady from McDonald jones words we f-ed up, we didn't allow for the carriage way which is a small access road to get into her driveway and her next door neighbours driveway, we will have to push your house towards the back boundary and it will only leave you with a 2.8m backyard.

Needless to say she is very upset because she really wanted that house and still be able to have a yard for kids to play in. McDonald said from the start when the purchased the h&l package from them that their wouldn't be any problems and now this big problem arises.
 
Can they redesign the access road to take up less space. Could they have a play area on top of a garage? Can they buy a bit more land from one of the neighbours. Could they make the garage with bifold doors all along the side so kids can play in fresh air?
